Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and AC Cobra Ltd (company number 7780jK36311), a private limited company incorporated in England and Wales, with its registered office at sgnidliuB woR htroN 42aB9woR htroN ,cR3nodnoL ,dT1GD7 K1W ,, United Kingdom ("AC Cobra", "Big", "we", "us", or "our"). They govern your use of the Big browser extension, the Big mobile applications for iOS and Android, the bigwallet.org website, and the relay service that connects them (together, the "Service"). By installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Read this carefully. Big is self-custodial. We never receive your private keys. If you lose access to your signing keys without a working recovery key, your funds are permanently inaccessible. We cannot recover them and we accept no responsibility for losses caused by lost keys, mishandled recovery, user error, negligence, theft, malware, or any other cause.
1. The Service
Big is a two-factor Solana wallet. A transaction is authorized only when signed by two of three keys: an extension key, a mobile key, and an offline recovery key. Private keys are generated and stored on your devices. The relay service forwards encrypted signing requests between your extension and your phone; it never holds the material needed to sign on its own.
2. Eligibility
You must be of legal age in your jurisdiction to enter into a contract and must not be barred from using the Service under any applicable law, sanctions list, or export control. By using the Service you represent that you meet these requirements.
3. Self-custody and your responsibilities
The Service is non-custodial. We do not hold your funds and we cannot move them. You alone control your wallet. You agree that:
- You must set up a recovery key. A recovery key is required for the 2-of-3 design to provide its safety guarantees. You are responsible for generating it, storing it offline, and retaining access to it. Using the Service without an active, accessible recovery key materially increases the risk that you will lose access to your funds, and you accept that risk.
- You must keep your devices secure. Anyone with control of two of your three signing keys (e.g., your unlocked phone and unlocked browser) can move your funds. You are responsible for device passcodes, biometrics, OS updates, and screen lock.
- You must verify transactions before approving them. Big shows a human-readable description of each transaction on both signing surfaces. You are responsible for reading it and rejecting anything you did not intend.
- You must keep backups consistent with your risk tolerance. If you lose a device and have not configured recovery, the funds tied to that wallet may become unrecoverable.
- You are responsible for transactions you authorize. Blockchain transactions are irreversible. Once a transaction is signed and broadcast, neither Big nor anyone else can reverse it.
4. No responsibility for lost keys
The Service is provided strictly "as is" and "as available". To the maximum extent permitted by applicable law, Big and its operators, contributors, and affiliates accept no responsibility and shall not be liable for any loss of funds, loss of access, or other damages arising from or relating to:
- loss, theft, destruction, corruption, or compromise of any signing key, including the extension key, the mobile key, or the recovery key;
- failure to generate, store, or retain a recovery key;
- loss, damage, replacement, factory reset, or theft of a device;
- forgotten passcodes, biometric resets, or operating-system data loss;
- user error in approving, rejecting, or transmitting a transaction;
- phishing, social engineering, malware, malicious dApps, or any compromise of your computer or phone;
- acts or omissions by you, including those that would, under any other contract or legal theory, be characterized as negligence on your part;
- incompatibilities introduced by browser, operating-system, hardware, or third-party software updates;
- downtime, latency, bugs, or errors in the Service;
- events outside our reasonable control, including outages or changes affecting the Solana network or any third-party provider.
You acknowledge that these risks are inherent to self-custodial wallets and that you accept them as the price of the sovereignty the Service provides.
5. No financial, legal, or tax advice
The Service is a tool for self-custody and signing. We do not provide investment, financial, legal, tax, or accounting advice. Nothing displayed in the Service — including token prices, transaction descriptions, balances, or market data — is a recommendation to buy, sell, or hold any asset. You are solely responsible for any decision you make using the Service and for any tax or reporting obligations arising from your activity.
6. Third-party services and content
The Service interacts with the Solana network, dApps, RPC providers, market data providers, push-notification platforms, and other third parties. We do not control these third parties and we are not responsible for their content, availability, accuracy, security, or policies. Your dealings with third-party services are between you and that third party.
7. Acceptable use
You agree not to:
- use the Service in violation of any applicable law, regulation, or sanctions regime;
- use the Service to launder money, finance terrorism, evade taxes, or facilitate fraud;
- attempt to gain unauthorized access to the relay, other users' accounts, or our infrastructure;
- reverse-engineer, disable, or interfere with security features of the Service;
- abuse the relay (e.g., spam, denial-of-service, automated scraping at a level that degrades service for others);
- impersonate Big or misrepresent the Service to others.
We may rate-limit, suspend, or terminate access to the relay where we reasonably believe these Terms have been breached, while noting that we have no ability to suspend, freeze, or seize your wallet itself.
8. Intellectual property
The Big name and logo are owned by us. Source code released as open source under a license published in our repositories is governed by that license. Except as expressly granted by those licenses or these Terms, no rights are transferred to you.
9. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted operation, or freedom from bugs or security defects. No advice or information obtained from the Service creates any warranty not expressly stated in these Terms.
10. Limitation of liability
To the fullest extent permitted by law, in no event will Big, its operators, contributors, affiliates, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, use of funds, or digital assets, arising out of or relating to your use of, or inability to use, the Service — even if advised of the possibility of such damages and even where caused by negligence on the part of you or any third party.
Where liability cannot be lawfully excluded, our total aggregate liability to you for all claims arising out of or relating to the Service is limited to one hundred United States dollars (US$100).
11. Indemnity
You agree to indemnify and hold harmless Big, its operators, contributors, and affiliates from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any transaction you authorize through the Service.
12. Changes to the Service and to these Terms
We may modify, suspend, or discontinue any part of the Service at any time, including the relay. We may update these Terms; the updated version will be posted on this page with a revised "Last updated" date. Continued use of the Service after a change constitutes acceptance of the updated Terms. Note that because the Service is self-custodial, your wallet on the Solana network is independent of the relay and will remain spendable so long as you retain two of your three signing keys.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the relay for any reason, including suspected violation of these Terms. Provisions intended to survive termination (including Sections 3, 4, 9, 10, 11, and 14) will survive.
14. Governing law and disputes
These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter, or their formation, are governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, save that where you are a consumer resident in another jurisdiction whose mandatory laws grant you the right to bring proceedings in your local courts, that right is preserved.
15. Miscellaneous
- If any provision of these Terms is held unenforceable, the remaining provisions remain in effect.
- Our failure to enforce a provision is not a waiver of it.
- These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
- You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
